What does a Victorian landlord owe when the roof leaks?

A serious roof leak in a Victorian rental is the landlord’s repair to organise, and the Residential Tenancies Act treats a serious roof leak as urgent. The tenant’s job is to report it. The short version

Victorian landlords have to keep rented premises in good repair. A roof that lets weather into a bedroom is not a grey area of taste. It is the building failing. The tenant should not be handed a bucket as the maintenance plan, and the tenant should not be told to “see how it goes over winter” when the plaster is already soft. Report, access, repair. That is the sequence that keeps people housed and ceilings intact.

Urgent means the water, not the inconvenience

The owner, or the agent the owner has told the tenant to use, should be told promptly, and the repair should be organised with matching speed. A dripping light fitting is not a job for the next quarterly inspection.

Not every roof mark is that urgent. A small stain that appeared once, with no active drip, still deserves a look. It may not deserve a midnight call-out. Say whether water is entering now. Active water, a ceiling that is bowing, or a leak into electrical fittings is the urgent version. An old ring in a laundry is the booked version. Both can be our work. The timing changes.

What the owner should do this week

Move the household’s plan for that room: beds out from under the drip, power off to a fitting that is wet, a bucket only as a bridge until the repair, not as the repair.

Ask for photos and a written scope, the same as any other roof job. A landlord who never sees the property still deserves to know whether they bought a flashing repair or a re-bed. Agents can pass the photos. They should not pass only a number. The owner who approves “make good, as discussed” will meet the same phrase on the next house with a different roof.

Keep records. The report from the tenant, the booking, the scope, the invoice. If the tenancy later becomes an argument, that folder is the evidence that the leak was treated as a repair. What tenants can usefully do

Report in writing. Include the rooms, the date it leaked, and whether it is still dripping. Photos of the ceiling help. Photos of the roof from a ladder do not, if getting them means climbing. Stay off the roof. A fall is worse than a stain, and a boot can crack the next tile.

Give access at the time you agreed. A repair that cannot enter cannot finish, and the delay will look like the owner’s even when the key was the problem. Move cars from a shared drive if that is the only ladder point. Pets away from the door. You do not have to accept a vague crew with no name. You do have to allow a genuine repair the owner has booked.

If the owner does not act, the Act sets out steps for urgent repairs, including limits and notice rules that change the tenant’s position. A wrong assumption there is expensive. A correct one is sometimes necessary. It is still not this company’s product.

Repairs, restores, and rentals that are really a sale

Many rental roofs are tired concrete tile. The leak is a ridge and the rest of the ridges match it. A landlord can authorise a local repair to stop today’s water and still owe the roof a plan. Doing only the local repair forever is how tenants live under a sequence of stains. Doing a full restore because one tile cracked is how a tight budget gets captured. The inspection should be allowed to say either.

End-of-lease pressure is real. A bond inspection will see the ceiling stain and call it the tenant’s mess if nobody documented the leak. The photos from the week it rained protect the tenant. The scope protects the owner from paying twice. Write them down while the weather is still the witness. The after-rain leak note is the household version of the first day. The obligation to organise the repair is the extra sentence that applies when the person sleeping under the stain is not the owner.
